Using Penny Ask

These Terms of Service apply when you use Penny Ask. By creating an account, purchasing messages, or using the service, you agree to these terms.

You must be at least 18 years old to use Penny Ask.

Your account

You need an account to use Penny Ask. You are responsible for keeping your password secure and for activity on your account.

Please contact us at support@pennyask.com if you believe someone else has gained access to your account.

Messages and purchases

Penny Ask uses a prepaid message system. You can purchase message packs through our website without a recurring subscription.

Purchased messages do not expire based on time and are added to your existing balance.

One successful answer from Penny Ask normally uses one message from your balance. If a request fails and no usable answer is provided, the message should not be deducted.

Message balances have no cash value, cannot be transferred to another account, and may only be used with Penny Ask.

Prices and any applicable taxes are shown during checkout. Payments are processed by our payment provider, Stripe.

Refunds are handled according to our Refund Policy.

Deleting your account

You can permanently delete your account from the My Account page.

Deleting your account removes your access to your chats and unused message balance. Account deletion does not automatically create a refund.

If you believe you qualify for a refund, contact us before deleting your account.

Acceptable use

You may not use Penny Ask:

  • for unlawful, fraudulent, abusive, or harmful activity;
  • to violate another person's privacy or intellectual property rights;
  • to attack, interfere with, overload, or attempt to gain unauthorized access to Penny Ask or another system;
  • to bypass security measures, usage limits, or safeguards;
  • to impersonate another person or misrepresent your identity;
  • for any activity prohibited by applicable law or by the policies of the technology providers used to operate Penny Ask.

We may restrict or terminate access when reasonably necessary to protect Penny Ask, our users, our service providers, or others.

AI-generated answers

Penny Ask uses artificial intelligence to generate responses.

AI-generated information can be incomplete, inaccurate, outdated, or misleading. Penny Ask does not guarantee that an answer is correct or suitable for your particular situation.

You are responsible for deciding how to use information provided by Penny Ask.

Medical, legal, financial, and other important matters

Penny Ask is not a doctor, lawyer, accountant, financial adviser, or other licensed professional.

Information provided by Penny Ask is for general informational purposes and should not be used as the sole basis for medical, legal, financial, safety, or other high-stakes decisions.

When professional advice is appropriate, consult a qualified professional.

Do not use Penny Ask as a replacement for emergency services.

Current information and web results

For some questions, Penny Ask may search the web for current information and provide source links.

Web information can change, and third-party websites may contain errors. Penny Ask does not control or endorse third-party websites simply because a source is shown.

Photos and voice

You may choose to submit a photo or voice recording.

You must have the right to provide any content you submit. Do not submit content that unlawfully violates another person's privacy, copyright, or other rights.

Voice recordings are used for transcription and are not intended to be permanently stored by Penny Ask. Photos may remain associated with your chat so that your conversation can be displayed later.

Your content

You retain your rights in the questions, text, photos, and other content you provide.

You give Penny Ask permission to process that content as necessary to provide, secure, maintain, and support the service.

AI-generated responses may not be unique. Other users may receive similar responses.

Service availability

We work to keep Penny Ask available and functioning properly, but we cannot guarantee uninterrupted or error-free service.

Features may occasionally be unavailable because of maintenance, technical problems, internet outages, third-party providers, security issues, or other circumstances outside our control.

We may modify, improve, suspend, or discontinue parts of the service when reasonably necessary.

Third-party services

Penny Ask relies on third-party providers for functions such as artificial intelligence, web search, payments, hosting, authentication, database storage, and email delivery.

Those providers operate under their own terms and privacy practices.

Disclaimer of warranties

To the maximum extent permitted by law, Penny Ask is provided "as is" and "as available."

We do not make warranties that the service will always be available, error-free, secure, or accurate, or that AI-generated responses will meet your particular needs.

Limitation of liability

To the maximum extent permitted by applicable law, Penny Ask will not be responsible for indirect, incidental, special, consequential, or similar damages arising from your use of or inability to use the service.

To the extent Penny Ask is legally responsible for a claim relating to the service, our total liability will not exceed the amount you paid to Penny Ask during the 12 months before the event giving rise to the claim.

Nothing in these terms limits rights or remedies that cannot legally be limited.

Changes to these terms

We may update these Terms of Service from time to time.

When we make changes, we will update the "Last updated" date on this page. If a change is material, we may provide additional notice when reasonably appropriate.

Continued use of Penny Ask after updated terms take effect means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of California, except where applicable law requires otherwise.
